About medical marijuana in Florida

Since the legalization of medical cannabis in 2016, over 656,000 Florida residents have benefited from the program. The state's medical cannabis program has expanded, providing patients with more consumption options. In 2019, Governor Ron DeSantis signed SB-182 into law, legalizing smokable medical marijuana and including raw flower among available products. The 2022 Florida Statutes allow patients to purchase edibles and other products from licensed Medical Marijuana Treatment Centers (MMTCs).

The Florida Marijuana Legalization Initiative (Initiative #22-05) is under review by the state Supreme Court and is expected to appear on the November 2024 ballot. Despite opposition from groups like the Drug-Free America Foundation and Florida Chamber of Commerce, the initiative has widespread support and could generate substantial tax revenues. Observers anticipate it will surpass the required 60% voter approval threshold.

Becoming a Medical Marijuana Patient in Florida

Possession/Use Limits and Cultivation

According to Florida state law, a certified physician may not issue a certification for more than three 70-day supply limits of marijuana or more than six 35-day supply limits of raw flower marijuana for smoking or vaping.

Registered patients’ daily THC doses are restricted to 60 mg for edibles; 350 mg for vaporization; 200 mg for capsules and tinctures; 190 mg for sublingual tinctures; 190 mg for suppositories; and 150 mg for topicals.

A 35-day supply limit for marijuana for smoking shall not exceed 2.5 ounces.

Future Cannabis Laws in Florida

The Justice Department proposed a new rule to reclassify marijuana as a Schedule III drug, which would ease federal restrictions on cannabis if approved. This reclassification would not legalize or decriminalize marijuana nationwide but would place it on the same regulatory level as ketamine and anabolic steroids. Currently, marijuana is classified as a Schedule I drug, meaning it has "no currently accepted medical use and a high potential for abuse." The proposed change would recognize marijuana as having "a moderate to low potential for physical and psychological dependence."

The proposal initiates a months-long comment and administrative period before any changes take effect. This follows President Biden's 2022 request for the Department of Health and Human Services (HHS) and the Justice Department to review marijuana's classification. HHS found credible scientific evidence supporting marijuana's medical use. The notice of proposed rulemaking reflects the attorney general's agreement with HHS's recommendation. President Biden hailed the move as "monumental," emphasizing marijuana policy as a priority of his administration, which has also worked to pardon those convicted of simple possession.
