About medical marijuana in Georgia

In April 2023, the first legal medical cannabis dispensaries opened in Georgia, allowing qualifying patients to purchase low-THC cannabis oil with their registry card. The state issues a "Low THC Oil Registry Card," allowing possession of up to 20 fluid ounces of low-THC oil for certified conditions. Unlike other states, Georgia prohibits the purchase or possession of cannabis in flower form, edibles, or vape pens. The state has decriminalized cannabis possession, imposing fines instead of jail time. Although Georgia continues to certify residents for low-THC oil, efforts are being made to push for full recreational use, but unresolved license lawsuits are causing delays.

Becoming a Medical Marijuana Patient in Georgia

DPH defines caregivers as the parent, guardian, or legal guardian of a minor under 18 or the legal guardian of an adult.

This follows President Biden's 2022 request for the Department of Health and Human Services (HHS) and the Justice Department to review marijuana's classification. HHS found credible scientific evidence supporting marijuana's medical use. The notice of proposed rulemaking reflects the attorney general's agreement with HHS's recommendation. President Biden hailed the move as "monumental," emphasizing marijuana policy as a priority of his administration, which has also worked to pardon those convicted of simple possession.
