Medical cannabis was legalized in New Jersey in 2010 by Gov. Jon S. Corzine, leading to the development of an efficient medical cannabis program over the past 13 years. Recreational cannabis sales began in April 2022, and the laws are continually being revised and updated.

Recently, Assembly Bill 5323 was passed, allowing certain tax deductions related to the sale, production, or distribution of cannabis products to offset the increased tax burdens placed upon dispensaries by Section 280E of the federal tax code.

Becoming a Caregiver in New Jersey

Elected caregivers must be at least 18 years old, a resident of New Jersey, and agree to help a qualified person use marijuana for medical purposes. Caregivers must submit fingerprints to undergo a background check. Once the caregiver has started internet registration, the fingerprinting forms will be accessible.

Caregivers are required to include:

How to Renew in New Jersey

New Jersey patients have separate expiration dates for their doctor's certification and state-issued medical marijuana card. The doctor's certification is valid for one year and must be renewed annually, while the state card is valid for two years and is renewed every other year.

Possession/Use Limits and Cultivation

Future Cannabis Laws in New Jersey

The Justice Department proposed a new rule to reclassify marijuana as a Schedule III drug, which would ease federal restrictions on cannabis if approved. This reclassification would not legalize or decriminalize marijuana nationwide but would place it on the same regulatory level as ketamine and anabolic steroids. Currently, marijuana is classified as a Schedule I drug, meaning it has "no currently accepted medical use and a high potential for abuse." The proposed change would recognize marijuana as having "a moderate to low potential for physical and psychological dependence."

The proposal initiates a months-long comment and administrative period before any changes take effect. This follows President Biden's 2022 request for the Department of Health and Human Services (HHS) and the Justice Department to review marijuana's classification. HHS found credible scientific evidence supporting marijuana's medical use. The notice of proposed rulemaking reflects the attorney general's agreement with HHS's recommendation. President Biden hailed the move as "monumental," emphasizing marijuana policy as a priority of his administration, which has also worked to pardon those convicted of simple possession.
